1. TERMS AND CONDITIONS

1.1 These Terms and Conditions govern your use of the Synovus Card Alerts Service. It is important that you read this document carefully and keep a copy for your records. If you have any questions about the Terms and Conditions, or do not wish to agree to these terms, please contact us at 1-888-SYNOVUS (796-6887) before continuing.

1.2 If you choose to access the Synovus Card Alerts Service through your mobile device, you also will be required to agree to the terms of a Software License before downloading the mobile app.

1.3 You may have other rights granted by law, and these Terms and Conditions do not affect such rights. Without limiting the foregoing, the terms and conditions for your deposit account, credit card account, or other of our products and services, continue to apply to such products and services and are not modified by these Terms and Conditions.

2. HOW TO CONTACT US

You can contact us by telephone at 1-888-SYNOVUS (796-6887). If you have any complaints about the Synovus Card Alerts Service, please write to us at Synovus Card Services, P.O. Box 120, Columbus, GA 31902; or call the number above.

3. FEES AND CHARGES

We do not charge any fees to use the Synovus Card Alerts Service. You still are required to pay all fees and charges for our other products and services, as are disclosed to you when you obtain those products or services. In addition, your mobile phone carrier or internet service provider may charge you fees, including for text messages and other data, and you should contact your carrier or service provider for details about their charges (if any).

4. WHO CAN USE THE Synovus CARD Alerts Service

4.1 To be eligible to register for and use the Synovus Card Alerts Service you must be 18 or older (19 or older if you live in Alabama) and a resident in the United States. In addition, you must have the following:

4.1.1 A Visa debit or credit card with us;

4.1.2 A compatible mobile phone or browser.

  • The website can be accessed from any device or computer that is Internet-enabled. The website is optimized for display on multiple browsers (Internet Explorer versions 8 and up; latest versions of Mozilla Firefox, Google Chrome, and Opera) and across a wide range of devices including smart phones, tablets, desktop and laptops.
  • The apps support iPhone and Android devices running the following operating systems: iPhone handsets running the iOS 6 operating system and above; and Android handsets running the 2.2 operating system and above. The mobile apps are also viewable via their complimentary tablets, however they are not optimized specifically for these products. Windows devices are not currently supported. The following minimum requirements must be met by your device: a smart phone with the ability to support a downloadable application (e.g. iPhone and Android); a mobile device with internet browsing (mobile web) capability; at least 64kb of free memory; be configured with the standard internet data connectivity settings for your network operator (GPRS, EDGE, or EV-DO), in addition to your normal voice plan, which enables services such as internet browsing and email receipt and delivery from your mobile phone; and free space available in your mobile phone, email, or service inbox to receive SMS (Text) and e-mail messages. To receive SMS (Text) Alerts only from the Synovus Card Alerts Service, the minimum device requirements are less. All you need is to have free space in your mobile phone, e-mail, or service inbox to receive SMS (Text) and e-mail messages.

4.1.3 A postal address within the U.S.

4.2 You can only register a participating Visa debit or credit card that you are lawfully entitled to use.

4.3 You are responsible for ensuring that your use of the software application does not cause you to breach any other agreement to which you are a party (for example, with your mobile network carrier or internet service provider).

4.4 You are solely responsible for your choice of equipment, wireless carriers, Internet or email service providers, web browsers, voice/data plans, etc. and for resolving any issues concerning operation, performance, availability, costs, etc., relating to any of the foregoing with the appropriate provider.

5. REGISTERING FOR AND AGREEING TO THE TERMS OF THE SERVICE

5.1 Once you have entered your registration details, you will be asked to confirm that the information is correct. If the information is not correct, you can revisit your registration and correct any mistakes before confirming and submitting your registration to us. It is your responsibility to ensure your registration is correct before submitting it to us. If you have any problems with your registration, please contact our support line at 1-888-SYNOVUS (796-6887).

5.2 When you submit your registration, you are requesting to subscribe to the Synovus Card Alerts Service. We may reject your registration if you are not one of our customers or otherwise fail to satisfy any of the criteria listed above.

5.3 When we receive your Visa debit or credit card account information, we will automatically verify that the information entered is correct, and that the card account belongs to you. Once these details are verified, your card will be activated for the Synovus Card Alerts Service. By using the Service, you agree to these Terms and Conditions.

5.4 If you elect to receive alerts on your mobile device (see Using the Synovus Card Alerts Service, below), you will be required to download the mobile app and agree to the terms of a Software License that will be provided to you. Use of the mobile app is subject to the terms and conditions of the Software License, and by downloading the software application, you accept the terms of the Software License. You should review the Software License prior to downloading the mobile app.

5.5 If we accept your registration, we will then send you a text message and/or e-mail confirmation, depending on the method(s) you chose for delivery of alerts.

6. USING THE SYNOVUS CARD ALERTS SERVICE

6.1 When you first use the Service, you will also be asked to choose a security passcode that you will need to enter each time you wish to use the Service. You must keep this passcode safe and not write it down or disclose it to anyone.

6.2 Within the Service application you may designate an email address and/or the number of a mobile device that accepts text messages to use for alerts. If the email address or mobile device number that you use for alerts changes, you are responsible for informing us of that change.

6.3 The Synovus Card Alerts Service provided by Synovus Bank is a service that gives you access to certain SMS (text) and e-mail alerts. According to your selections, we will send alerts to the email address or mobile number you provide to us in on our website or in the mobile app.

6.4 Once you have registered for the Synovus Card Alerts Service using your mobile device or computer, you will be provided the list of alerts that you may choose to use. You then may select the alerts you would like to receive. If you later want to change your alert choices, you can do so by signing into your account and changing your selections.

6.5 The Synovus Card Alerts Service is normally available 24 hours a day, 7 days a week, and 365 days a year, apart from planned downtime, circumstances beyond our reasonable control, outages on any mobile phone network, or where you are not in an area of mobile coverage.

6.6 The information in any alert may be subject to certain lag times or delays in transmission, and we make no representation concerning either the delivery or accuracy of any alert. Alerts are provided as a convenience only and should never be considered as an official bank record or as a substitute for the information contained in your periodic statements. We may provide important information to you through other methods, including electronic messaging within the service. You agree that we will not be liable for (i) any delays, failure to deliver, or misdirected delivery of any alert, (ii) any errors in the content of an alert, or (iii) any actions taken or not taken by you or any third party in reliance on an alert.

6.7 In our sole discretion, we may add new alert types and/or discontinue alert types at any time and from time to time without notice to you. Further, you acknowledge that we may withdraw all or part of the Synovus Card Alerts Service without notice.

6.8 The Synovus Card Alerts Service can be used abroad in countries with compatible mobile networks, though charges imposed by your network provider could be higher.

7. ADDING EXTRA CARDS

You may add another card and additional features to the service from within the software application at any time by following the simple steps in the application software. We will automatically verify each new card request before activating the card for the Synovus Card Alerts Service.

8. SECURITY

8.1 We do not store confidential or sensitive information such as user IDs, passwords or account numbers on your wireless device in connection with the services. You should safeguard your mobile device, user ID and password against loss or theft. You should delete any alerts or other text messages sent or received in connection with any Service. We have no responsibility or liability to you or any other person in connection with any such messages you choose to save on your mobile device. If your device is lost or stolen, report it immediately to your wireless provider.

8.2 Alerts are not encrypted. You should be aware that anyone with access to your email and/or text will be able to view the content of these alerts.

8.3 You must not disclose your security details to any other person or record your security details in any way that may result in them becoming known to another person. If you suspect that anyone knows your security details, you must contact us immediately.

9. LIABILITY

9.1 Except as otherwise required by law, we are not liable for any losses you suffer arising from fraudulent use of your card or third-parties viewing the alerts we send to you where this results from you not keeping your security details safe, as recommended by us.

9.2 If your mobile phone is lost or stolen, you must tell us (by contacting Synovus Bank at

1-888-SYNOVUS (796-6887)) as soon as is reasonably practicable, and in any case within 24 hours of the loss or theft. In addition, it is your responsibility to advise your mobile phone provider of the loss or theft of your mobile phone. Until you tell us that any of these things have happened we will continue to provide the Synovus Card Alerts Service to your mobile phone and we will not be liable if your account information becomes known to someone else as a result.

9.3 We are not liable for any error by you in entering any details when you use the Synovus Card Alerts Service (e.g. if you key in the wrong mobile number).

9.4 If we believe that you or someone else is using or has obtained, or may use or obtain, the Synovus Card Alerts Service illegally, fraudulently or improperly, then we may cancel or suspend your use of the Synovus Card Alerts Service without notice.

9.5 We will not be liable to you if the Synovus Card Alerts Service is not available to you due to any planned downtime, circumstances beyond our reasonable control, outages on any mobile phone network or where you are not in an area of mobile coverage.

9.6 The Synovus Card Alerts application is provided "as is" with no representation, guarantee or warranty of any kind as to its functionality. We cannot guarantee that the application will be compatible with every type of mobile phone.

9.7 SYNOVUS BANK, VISA INC. AND THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, DIRECTORS AND THE MANUFACTURER OF YOUR MOBILE PHONE WILL NOT BE LIABLE FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES, INCLUDING LOSS OF REVENUE OR INCOME, PAIN AND SUFFERING, EMOTIONAL DISTRESS, OR SIMILAR DAMAGES, EVEN IF SYNOVUS BANK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL THE COLLECTIVE LIABILITY OF SYNOVUS BANK, VISA AND THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, DIRECTORS AND THE MANUFACTURER OF YOUR MOBILE PHONE TO ANY PARTY (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED $100.

9.8 IN NO EVENT WILL SYNOVUS BANK BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOSSES OR EXPENSES ARISING FROM THE SYNOVUS CARD ALERTS SERVICE OR USE THEREOF OR INABILITY TO USE BY ANY PARTY, OR IN CONNECTION WITH ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR LINE OR SYSTEM FAILURE, EVEN IF WE, OR OUR REPRESENTATIVES, ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, LOSSES OR EXPENSES.

10. YOUR RIGHT TO CANCEL

10.1 If you wish to deactivate your account, simply select the "Cancel Service" or "Cancel Account" option, follow the instructions and then delete the software application from your mobile phone.

10.2 It is your responsibility to delete the software application from your mobile phone if you change your mobile phone or dispose of it.

10.3 In the event you request that we close an account or your Mobile Banking profile, you acknowledge and agree that we may continue to send you alerts associated with that account or your Mobile Banking profile for a reasonable time thereafter until the closure process is completed.

10.4 You agree that we will not be liable to you or any third party for any modification or discontinuance of the Synovus Card Alerts Service.

11. OTHER IMPORTANT INFORMATION

11.1 We have the right to change these Terms and Conditions at any time, and you will be notified in writing by us with regard to the changes.

11.2 If we believe that any change to the Terms and Conditions is likely to cause you material disadvantage, we will let you know as soon as possible prior to any change.

11.3 If you do not agree with any change to the Terms and Conditions, you are free to stop using the Synovus Card Alerts Service at any time. If you wish for us to deactivate your account, simply select the "Cancel Service" or "Cancel Account" option, follow the instructions, and then delete the software application from your mobile phone.

11.4 We may not necessarily keep a copy of your order and these Terms and Conditions. Accordingly, we advise you to keep a record of your order and a copy of these Terms and Conditions for your information and reference.

11.5 The contract and all communications between us will be conducted in the English language.

11.6 Our relations with you and the formation, existence, construction, performance, validity and all aspects whatsoever of these Terms and Conditions, or of any term of these Terms and Conditions, will be governed by the laws of the State governing your Visa debit or credit card (as applicable) with us, whose courts shall have non-exclusive jurisdiction to settle any disputes which may arise out of or in connection with these Terms and Conditions.

11.7 You acknowledge that there may be third parties who have rights under these Terms and Conditions (including, without limitation, our suppliers, the software application developer and the manufacturer of your mobile phone) and you acknowledge that, to the extent permitted by law, those third parties may exercise their rights under these Terms and Conditions even though they are not a party to them.
